Arizona law requires any out-of-state healthcare provider offering telehealth services to Arizona residents to appoint a statutory agent for service of process. This is part of the Interstate Telehealth Provider Registration established by House Bill 2454, signed into law on May 5, 2021.
Arizona defines “telehealth” as the interactive use of audio, video, or other electronic media (including asynchronous tech and remote monitoring) for providing healthcare services such as assessment, diagnosis, consultation, or treatment. This includes audio-only calls if video isn’t reasonably available.
However, telehealth does not include fax, instant messaging, voicemail, or email as valid methods of healthcare delivery.
